הַגַּגּוֹת פְּטוּרִין, אַף עַל פִּי שֶׁהֵם שֶׁל חָצֵר הַחַיָּבֶת. בֵּית שַׁעַר, אַכְסַדְרָה וּמִרְפֶּסֶת, הֲרֵי אֵלּוּ כֶּחָצֵר, אִם חַיֶּבֶת, חַיָּבִין, וְאִם פְּטוּרָה, פְּטוּרִים:
Os telhados isentam [o produto], mesmo que pertençam a um pátio que o faz exigir o dízimo. Uma casa de portão, um pórtico ou varanda, são como o pátio [ao qual estão ligados]; se [o pátio produz os produtos] exigir [dízimos], eles o fazem exigir e, se isentar, eles isentarão.

Rabbi Shimon ben Elazar says in the name of Rabbi Akiva, any [courtyard] that one opens and another closes, such as two joined [courtyards] with two [different] occupants, the roofs are exempt, even if they are [located] within a courtyard that is liable. (Maasr. 3:5.) [In such a case,] they may ascend to the top of the roof and eat.
