הַגַּגּוֹת פְּטוּרִין, אַף עַל פִּי שֶׁהֵם שֶׁל חָצֵר הַחַיָּבֶת. בֵּית שַׁעַר, אַכְסַדְרָה וּמִרְפֶּסֶת, הֲרֵי אֵלּוּ כֶּחָצֵר, אִם חַיֶּבֶת, חַיָּבִין, וְאִם פְּטוּרָה, פְּטוּרִים:
Los techos eximen [producir], a pesar de que pertenecen a un patio que hace que [producir] requiera [diezmar]. Una puerta de entrada, pórtico o balcón, estos son como el patio [al que están unidos]; si [el patio produce el producto] requiere [diezmos], lo hacen requerir, y si lo hace exento, lo hacen exento.

Rabbi Shimon ben Elazar says in the name of Rabbi Akiva, any [courtyard] that one opens and another closes, such as two joined [courtyards] with two [different] occupants, the roofs are exempt, even if they are [located] within a courtyard that is liable. (Maasr. 3:5.) [In such a case,] they may ascend to the top of the roof and eat.
