הַגַּגּוֹת פְּטוּרִין, אַף עַל פִּי שֶׁהֵם שֶׁל חָצֵר הַחַיָּבֶת. בֵּית שַׁעַר, אַכְסַדְרָה וּמִרְפֶּסֶת, הֲרֵי אֵלּוּ כֶּחָצֵר, אִם חַיֶּבֶת, חַיָּבִין, וְאִם פְּטוּרָה, פְּטוּרִים:
Dächer machen [Produkte] befreit, obwohl sie zu einem Innenhof gehören, der [Produkte] [Zehnten] erfordert. Ein Torhaus, ein Portikus oder ein Balkon, diese sind wie der Innenhof [an den sie angeschlossen sind]; Wenn [der Hof die Produkte herstellt] [den Zehnten] verlangt, machen sie es erforderlich, und wenn es befreit, machen sie befreit.
Tosefta Maasrot
Rabbi Shimon ben Elazar says in the name of Rabbi Akiva, any [courtyard] that one opens and another closes, such as two joined [courtyards] with two [different] occupants, the roofs are exempt, even if they are [located] within a courtyard that is liable. (Maasr. 3:5.) [In such a case,] they may ascend to the top of the roof and eat.
