מַתְנֶה אָדָם עַל עֵרוּבוֹ וְאוֹמֵר, אִם בָּאוּ גוֹיִים מִן הַמִּזְרָח, עֵרוּבִי לַמַּעֲרָב. מִן הַמַּעֲרָב, עֵרוּבִי לַמִּזְרָח. אִם בָּאוּ מִכָּאן וּמִכָּאן, לִמְקוֹם שֶׁאֶרְצֶה אֵלֵךְ. לֹא בָאוּ לֹא מִכָּאן וְלֹא מִכָּאן, הֲרֵינִי כִבְנֵי עִירִי. אִם בָּא חָכָם מִן הַמִּזְרָח, עֵרוּבִי לַמִּזְרָח. מִן הַמַּעֲרָב, עֵרוּבִי לַמַּעֲרָב. בָּא לְכָאן וּלְכָאן, לִמְקוֹם שֶׁאֶרְצֶה אֵלֵךְ. לֹא לְכָאן וְלֹא לְכָאן, הֲרֵינִי כִבְנֵי עִירִי. רַבִּי יְהוּדָה אוֹמֵר, אִם הָיָה אֶחָד מֵהֶן רַבּוֹ, הוֹלֵךְ אֵצֶל רַבּוֹ, וְאִם הָיוּ שְׁנֵיהֶם רַבּוֹתָיו, לִמְקוֹם שֶׁיִּרְצֶה יֵלֵךְ:
Un homme fait une stipulation sur son érouv, en disant: "Si les idolâtres viennent de l'est, mon érouv est à l'ouest; si de l'ouest, mon érouv est à l'est." [Il place deux eruvin; un, deux mille coudées à l'est de sa maison, et un, deux mille coudées à l'ouest, et il dit: Si les idolâtres viennent de l'est et que je dois les fuir, que mon érouv à l'ouest fasse (acquisition) pour moi, de sorte que j'ai quatre mille coudées à l'ouest de ma maison. Et même s'ils ne viennent que le lendemain (sabbat), nous disons qu'il y a breirah (désignation rétroactive), que ben hashmashoth son érouv de l'autre côté (l'ouest) a effectué l'acquisition pour lui.] (Il dit :) "Si ils viennent des deux côtés, j'irai où je veux. " "S'ils ne viennent d'aucun côté, je suis comme l'un des (autres) hommes de ma ville." [c'est-à-dire que j'ai deux mille coudées de ma ville de chaque côté, et je n'ai pas besoin de gagner dans une direction et de perdre dans une autre.] "Si le sage vient de l'est, mon érouv est à l'est; si de l'ouest, c'est à l'ouest. " [(S'il vient) en dehors du tchum de ma ville, et je souhaite apprendre de lui— et maintenant je ne sais pas s'il viendra —et demain j'entendrai des hommes qui viennent d'ici à partir de là au moyen d'un érouv, etc.] "S'il (c'est-à-dire un sage) vient de chaque côté, j'irai où je veux." "S'il ne vient d'aucun côté, je suis comme l'un des (autres) hommes de ma ville." R. Yehudah dit: Si [ils venaient des deux côtés et] l'un d'eux était son professeur, il va vers son professeur [et non vers l'autre, car nous posons que lorsque son érouv a effectué l'acquisition de ben hashmashoth, sa volonté était que le eruv dans la direction de son professeur, faites-le.], et si tous deux étaient ses professeurs, il va où il veut. [La halakha n'est pas conforme à R. Yehudah, qui favorise parfois son ami par rapport à son professeur.]

HALAKHAH: “If somebody preliminarily marries two women with the value of a peruṭah,” etc. It was stated: “In all these cases, if they had intercourse they acquired. Rebbi Simeon [ben] Jehudah says in the name of Rebbi Simeon: In all these cases, if they had intercourse they did acquire since his intercourse was predicated on the preceding preliminary marriage.” What did they acquire? Rebbi Ḥiyya in the name of Rebbi Joḥanan: They acquired for restrictions. Rebbi Ḥiyya in the name of Rebbi Joḥanan: With any condition which refers to a preceding action, she is preliminarily married for restrictions. Rebbi Mana asked before Rebbi Yudan: Who is the Tanna who stated: “Any condition which refers to a preceding action is invalid”? This does not follow Rebbi Simeon. Rebbi Yudan in the name of Rebbi Joḥanan: She is preliminarily married for restrictions. How is that: “I am marrying you preliminarily by intercourse on condition that rains should fall.” If rain fell, she is preliminarily married, otherwise she is not preliminarily married. Rebbi Ḥiyya in the name of Rebbi Joḥanan: In matters of a preliminary marriage by a loan for restrictions, for real estate it was not acquired, for movables one does not deliver him to “Him Who exacted retribution.” If [the buyer] insists on the deal? Let us hear from the following: “You have wine to get from me, when he had no wine.” Therefore, if he had wine he would be obligated to deliver. Rebbi Ḥiyya stated, if he has wine he is obligated to deliver. Rebbi Samuel ben Rav Isaac did (not) say there: You should know that Rebbi Ḥiyya instructed following Rebbi Joḥanan that a preliminary marriage by a loan is for restrictions. Rebbi Ze‘ira resented it. Why? Because they were restrictive in practice and he taught them leniency? Rebbi Yose ben Rebbi Abun said, they were lenient in practice and he taught them to be restrictive, that if another man came and married her preliminarily, his marriage would hold. Rebbi Yudan ben Rebbi Ḥanan said, if there is a doubt between adultery and no adultery, decide on no adultery.

Rebbi Abbahu in the name of Rebbi Joḥanan: The following is the contract text: “I, X son of Y, contract a preliminary marriage with you, Z, daughter of U, on condition that I shall give you property A anddefinitively marry you by day B. If that day should pass without me having taken you in, I shall have no claim on you.” If anything intervened beyond his control? Rebbi Joḥanan said, matters beyond his control are as if he were inactive. Rebbi Simeon ben Laqish said, matters outside his control are as if he had acted. In the opinion of Rebbi Simeon ben Laqish, what would be necessary? “If that day should pass without you having taken me in, I shall have no claim on you.” When Rebbi Joḥanan was dying, he told his daughters to act following Rebbi Simeon ben Laqish. He said, maybe in the future there might be a court which follows him; then his descendants might be in danger of bastardy.
