Rebbi Jehudah bar Pazi said, who is the Tanna of pecking? “Rabban Gamliel says, also the snake because it spits out172Mishnah Parah 9:3. The Mishnah states that water drawn for the purification rite of the ashes of the red cow becomes unusable if any animal drank from it because some of the animal’s spittle will be mixed with the water. In general, reptiles are reputed not to invalidate the water. Rabban Gamliel declares the snake to invalidate the water because it always will deposit some of its poison. Since the opinion of Rabban Gamliel is a minority opinion not followed in practice, R. Jehudah bar Pazi implies that the Mishnah here does not represent practice..” Rebbi Jonah said, who would turn commandments into peckings for us173The rules given here are rules of hygiene, rather than religious observance. Therefore, the reference to Rabban Gamliel is irrelevant and the Mishnah here does represent practice.?
